Underwriting FAQs

Question: Do I need workers' compensation coverage?
Answer: According to WV Code, Title 23, Section 2-1, "all persons, firms, associations and corporations regularly employing another person or persons for the purpose of carrying on any form of industry, service or business in this state," are required to apply to BrickStreet Mutual Insurance Company for workers' compensation coverage until the market opens to other insurers on July 1, 2008. However, employers of employees in domestic service, employers of five fewer full-time employees in agricultural service, casual employees (defined as three or less employees; employment is temporary, intermittent and sporadic and does not exceed 10 days in any calendar quarter), churches, employers engaged in organized professional sports or volunteer police auxiliary unit under the auspices of a county commission, municipality or other government entity are not required to obtain coverage, but may elect to do so.

Question: What are the benefits of workers' compensation coverage?
Answer: Employers insured by BrickStreet receive civil immunity in which employers shall not be liable to respond to damages at common law or by statute for the injury or death of any employee, except in the case of negligence.

Question:: Does BrickStreet offer additional coverages?
Answer: BrickStreet specializes in workers compensation insurance and does not offer additional commercial lines such as auto, property or general liability. However, three coverage options are available to supplement your workers compensation policy.

Question: How do I calculate my premium?
Answer: Premium is calculated based on two factors, final rate per $100 and employee gross payroll. To calculate your premium, divide your gross payroll by 100 and multiply the answer by your final rate.

Question: How do I cancel / terminate my policy?
Answer: If your business no longer has employees in West Virginia, you may cancel your policy completing a BI-362 Cancellation Request/Policy Release

Please advise us if you have sold or transferred any assets of your Business. If you have sold or transferred control of any portion of your business, please provide documentation explaining what has transpired between the previous operating business and the current business, the successor. Include a copy of purchase/merger agreement and proof of entitlement (a letter from purchasing/controlling business stating predecessor is entitled to workers' compensation refund) if predecessor is entitled to a refund.

Question: What should I do if I believe my classification(s) and/or payroll estimate information on my policy should be changed?
Answer:
